This notice explains what BeAdvised Legacy Ltd does with your personal information, why, and what rights you have over it.
Who we are
BeAdvised Legacy Ltd, trading as BeAdvised Legacy Planning, is the data controller for the information described here. We are registered in England and Wales and registered with the Information Commissioner’s Office. You can reach us on 01793 228068 or at hello@beadvisedlegacy.co.uk.
What we collect
- When you enquire: your name, phone number and what you have asked about.
- When you become a client: the information needed to advise you and draft your documents — your address and date of birth, details of your family and relationships, your property, savings, pensions, business interests and existing arrangements, and the names of the people you want to appoint or benefit.
- Automatically: our analytics records page views without cookies and without anything that identifies you. See our cookie notice.
Some of what we hold is special category data or relates to criminal convictions — health information relevant to capacity, for example. We only collect it where it matters to the advice, and we handle it on the basis of a substantial public interest in providing legal services, or with your explicit consent.
Why we are allowed to use it
- To perform our contract with you — drafting, registering and storing your documents.
- Our legitimate interests — responding to your enquiry, keeping records of the advice we have given, and protecting the firm against claims.
- Legal obligations — anti-money-laundering checks, tax records, and reporting duties.
- Your consent — sharing your information with BeAdvised (financial planning), and sending you updates about legislation. You can withdraw either at any time.
Who we share it with
We do not sell your information and we do not share it for anyone else’s marketing. We share it only with:
- BeAdvised (financial planning) — a separate business — and only where you have given your explicit consent. We will only share information that is necessary and relevant to the service being provided, and you can withdraw your consent at any time.
- Suppliers who process data on our behalf: our email provider, our website host, and our secure document storage. They act on our instructions and cannot use your information for their own purposes.
- Third parties where the work requires it: the Office of the Public Guardian when registering a lasting power of attorney, HMRC where a trust must be registered, and the Land Registry where a property is involved.
- Anyone we are legally required to tell, including law enforcement and regulators.
Our website and consent records are held in Google Cloud data centres in the United Kingdom or the European Economic Area. Where any supplier processes data outside the UK, we rely on UK adequacy regulations or the International Data Transfer Addendum.
How long we keep it
- Enquiries that do not become instructions: up to 12 months.
- Client files, wills and related documents: for the life of the document and for a period afterwards, reflecting the long tail of claims about estate planning advice. Where we store original documents, we hold them until you or your executors ask for them back.
- Consent records: kept for as long as we rely on the consent, and for a period afterwards so we can evidence what was agreed and when. Consent records are append-only: withdrawing consent adds a record, it does not erase the original.
Your rights
Under UK GDPR you can ask us to:
- give you a copy of the information we hold about you;
- correct anything that is wrong;
- delete information, where we do not need to keep it;
- restrict or object to how we use it;
- transfer it to another provider, where it was given to us electronically; and
- withdraw consent, at any time, without affecting anything done beforehand.
Ask by phone or email and we will respond within one month. There is no charge. If you are unhappy with how we have handled your information, please tell us first so we can put it right — see our complaints procedure. You also have the right to complain to the Information Commissioner’s Office at ico.org.uk or on 0303 123 1113.
Changes to this notice
If we change how we use your information we will update this page and change the date at the top. Where the change is significant, we will tell you directly.
