A small town with unusual assets
Cricklade is a small Saxon town, and most of the estates we deal with here are modest and straightforward — a house, some savings, a pension, and children who get on. For those families a mirror will and a pair of lasting powers of attorney is genuinely the whole job, and we are not going to invent complexity to justify a bigger fee.
What does come up more often around Cricklade than elsewhere is the second property. The Cotswold Water Park on the doorstep means a fair number of local families own a lodge, a holiday let, a static caravan or a share in one, and these are the assets most likely to be dealt with badly. Many are held on leases with restrictive terms about who may occupy or inherit them, some cannot be occupied as a main residence at all, and a good number are jointly owned with a sibling or a friend on nothing more formal than a handshake.
A furnished holiday let is also treated differently from a family home for both inheritance tax and capital gains purposes, and it does not attract the residence nil-rate band. Where one exists, the will needs to say clearly who gets it, whether they are expected to keep running it, and what happens if they do not want it — otherwise the executors are left trying to sell an asset with a restricted market while paying the site fees out of the estate.

This is old country — North Meadow has been managed in the same way for the best part of a thousand years — and it is not unusual to find rights of common, unregistered strips, and boundaries that everyone locally understands and no document records. Where a property has been in a family for generations, we check the title early, because sorting out an unregistered title after a death is slower, dearer and lands on people who are already dealing with a bereavement.
Flooding is a practical consideration too. Where a property sits on the flood plain, the insurance position, and whether cover would transfer to a beneficiary, is worth knowing before someone inherits it rather than after.
